RAPID CITY -- A 41-year-old Rapid Valley man was charged early Tuesday
with murdering a 21-year-old woman who came to his home last week to sell magazines.
Neil Frame, 3030 Gypsey Road, faces first-degree murder charges in the death of Kristina Moore
of Lancaster, Calif. Moore disappeared Wednesday evening while working for a door-to-door
magazine crew in the Rapid Valley area where Frame lived.
Moore's body was found Friday morning in a field near Hermosa.
During a news conference Tuesday morning, city, county and state law-enforcement
officers said autopsy results showed that Moore had suffered a blow to the head but
died of asphyxiation from strangulation.
When she was found Friday, she still had a plastic zip tie around her neck,
Pennington County State's Attorney Glenn Brenner said.
There also were indications on the body that a stun gun might have been used, Brenner said.

Diane Cooper Murdered

Diane Cooper's daughters Monday morning
signed a $1 million settlement of their lawsuit
against Palmetto Marketing, Inc., the Florida-based
company whose employee murdered Cooper in May of 2000.
Cooper was murdered in her Fulton home by Matthew Maxson,
a door-to-door magazine salesman.
Police believe Cooper had let the young man into her home.
She was stabbed with a knife and with a broken bottle.

Abstract (Article Summary)
When Bridgette Latrice Brown, 23, knocked on the door of a Seattle woman's home
and told her she was selling magazines to help get kids off the streets,
the woman believed her. But when Brown asked the woman to take her to a motel,
then grabbed a knife and threatened to take her life . . . the woman was shocked.

"I have never seen a stranger case," said King County Senior Deputy Prosecutor
Kathy Goater, who heads the special assault unit. "A forcible rape of a woman by
another woman? It rarely happens. In the context of a strange rape, I've never
seen one like this before."

Angel Trevino is haunted by the memories of holding her friend
who lay dying along the highway.
The two had been on a crew together for eight months
at All-Star Promotions, a magazine subscription
sales company based in Pilot Point, Texas. They had been working
in Destin, Fla., and had left just after midnight Oct. 26, 1997, on
their way back to Texas. It had begun to rain as they were driving
through Jackson, Miss., at about 9 that morning. The van swerved as the
driver tried to pass another car, and rolled off the road,
throwing Amber Stankovich, 19, onto the pavement. Trevino's legs were crushed,
but she was conscious. She dragged herself through the shattered windshield.
The four others in the crash were shaken, but none was as bad off as Stankovich.
Trevino would tell an investigator for Parent Watch, an industry watchdog:
"We couldn't find Amber, because she was in a ditch. I finally saw her and wanted to go to her,
but there was this barbed wire in the way. The ambulance people brought her up and put her next to me.
They said she had a heartbeat but wasn't breathing. I started freaking out, but they told me to talk
to her and try to bring her back, that sometimes that helps."

A magazine salesman revisited the apartment of an 88-year-old woman
who turned down a subscription and attacked her, police said Saturday.
Samuel A. Erby, 20, was arrested a few minutes after the assault Wednesday.
He was in jail Saturday, charged with injury to an elderly person.
Police said the salesman tried to suffocate the woman with her scarf.
Then he tried to smother her with his hand as she fought him and screamed.
He ran away and a neighbor called 911.
Police found the woman lying on the floor near her front door.
She was treated for cuts and bruises.

Firm illegally selling magazines door-to-door here settles lawsuit

A Washington business and its president have paid $5,000 to settle accusations
stemming from their involvement in the illegal door-to-door sale of magazine
subscriptions in southcentral Pennsylvania.
The defendants also agree to make restitution both to consumers who didn't get the
subscriptions they paid for and to sales personnel who didn't get promised salaries and bonuses.
A consent petition filed this week in Lancaster County Court identifies the defendants
as NCS Corp., Gig Harbor, Wash., and its president, William Gillespie.
In August 1992, the attorney general's office sued NCS and several other corporations.
Among other things, the lawsuit alleged that the defendants:
Charged consumers a $7 "processing fee" that wasn't adequately disclosed or explained.
Failed to properly register with the state.

Things sounded so good when Preston went for an interview at a local hotel

What followed was the worst three months of her life. Preston says she was taught
to lie to customers to make sales. She found herself knocking on doors six days a week
from 9 a.m. to as late as 2 in the morning.

Article Abstract:
A 23-year-old Mississippi man who sold magazines door to door was in custody
at Santa Clara County Jail Thursday after being arrested on suspicion of
raping a woman in East San Jose.
Police said the man forced his way into the residence after the woman
-- described as being in her 20s -- opened her front door. Officers
would say only that the rape occurred about 3 p.m. Tuesday near White
Road and Cunningham Road. The man choked the victim and kicked her, raped
her and then fled out the rear of her house, police said.
Sgt. Greg Trapp said an officer responding to the call recognized the
description as resembling a magazine salesman in the same neighborhood.
Trapp said investigators then interviewed neighbors, who were able to
describe the man and the identity card he used to sell magazines.
After checking with the city's permit division, the police determined
that the man worked for American Community Services Inc.,
which sells a variety of magazines.

Salesman found guilty of Woburn murder

Bernice Clark, 76, was found stabbed to death in her Senator Road home July 13.
Hours later, Darrin Whitman, an employee of an Indiana-based soliciting company,
was arrested by state and Woburn police and charged with the killing.
A Middlesex Superior Court jury deliberated approximately two hours before
finding that Darrin Whitman, 24, had killed Clark, a retired beautician,
with deliberate premeditation.
Whitman was one of a large group of young people brought into the
Woburn area last summer by American Community Services of Michigan City,
Ind., to sell magazines and had sold a subscription to Clark earlier in the day.
Evidence showed he later came back, made Clark undress and lie on the bed
before stabbing her four times, once in the heart.

On August 19, 1982, David W. Steffen talked his way into
the home of a 19-year old Cincinnati woman. David Steffen,
a young door-to-door salesman, was selling a cleaner
product which was packaged by Hy-Pro Chemical.
The 19-year-old Cincinnati woman allowed
him in to give her a demonstration.
The Cincinnati woman watched as Steffen scrubbed the tile
under the sink.
When he stood up, Steffen brushed against her breast.
She started to scream. Steffen warned her to stop but she
continued. Steffen then beat her severely, ran into the
kitchen, found a paring knife and returned to the bathroom
where he raped her and cut her throat.
Steffen beat her, broke her nose, choked her and slashed
her throat 4 times. He left the home after raping her,
leaving her body for her mother to find.

Up to a housewife's door in Alexandria, La. one day in 1949 stepped Magazine Salesman Jack H. Breard to sell combination subscriptions to several magazines (Saturday Evening Post, Newsweek and Ladies Home Journal). But Breard was really trying to get arrested, to test a city ordinance forbidding door-to-door visits without prior permission of householders. Obligingly, Alexandria's police arrested Salesman Breard, and he was ordered to pay a $25 fine or go to jail for 30 days.

Three associations, representing door-to-door sellers of everything from Fuller Brushes to encyclopedias, joined with Breard to appeal his case, since the law dealt a heavy blow to the house-to-house selling of $1.4 billion in consumer goods each year, including some 10,000,000 magazine subscriptions. They wanted to test the constitutionality of the "Green River" ordinance which over 400 U.S. communities have adopted since Green River, Wyo. passed the first one in 1931 to slam the door on solicitors. Breard's lawyers charged that his arrest violated both freedom of the press and free speech. Last week, by 6-to-3, the U.S. Supreme Court ruled otherwise, affirmed the right of any community to restrict door-to-door selling. Justice Stanley Reed, speaking for the majority, wrote: "Subscriptions may be made by anyone interested in receiving the magazines without the annoyances of house-to-house canvassing."

Today Governor Jim Doyle signed into law legislation that will protect traveling sales crews from abuse by employers.

On March 25, 1999, seven young people were killed when their van crashed in Janesville.

They were part of a traveling sales crew.

18-year-old Malinda Turvey was one of the seven killed.

Today, her father was on hand to see Governor Doyle sign Malinda's Act.

" There is no closure. "

About a decade ago Phil Ellenbecker's daughter, Malinda, and six of her co-workers were killed when the van they were in crashed.

Five other people were seriously injured.

They were working for a subscription sales company in Iowa.

At that time the traveling sales industry was mostly unregulated.

" Up until now there has never been any real state or federal legislation or regulation whatsoever."

But that changed today when Governor Doyle signed Malinda's Act.

" This law, among other things, will help protect people from abuses from disreputable employers."

The new law requires employers who use traveling sales crews in Wisconsin or who recruit here to register with the Department of Workforce Development.

All vehicles used by crew members have to be certified for all safety codes and workers have to be paid on a semi-monthly basis for wages earned.

" This is the most extraordinary experience I've ever had. "

Ellenbecker played a pivotal role in this legislation's development and was at the capitol to see it signed into law one day after the ten-year anniversary of Malinda's death.

" I am so grateful for all the hard work of everyone. And the final outcome is exactly what we wanted. "

Ellenbecker says he's tired after this ten year fight.

So he's going to take some time off.

But he says he isn't done just yet.

"There's 49 more states and we have to make sure that they are protected too."

Ellenbecker says he wants other states to adopt similar legislation.

He also says he wants some sort of **federal regulation when it comes to the traveling sales industry.

Ellenbecker is in the process of gathering support from other lawmakers to make that happen.

MADISON—Governor Jim Doyle today signed into law legislation that will protect traveling sales crews from abuse by employers and sets regulations that also protect consumers and homeowners. Malinda’s Act, SB4, is a response to the tragic traveling sales crew van crash on March 25, 1999 in Janesville, which killed 7 people, including 18-year-old Malinda Turvey from Verona, and severely injured 5 others.

“Today is bittersweet,” Governor Doyle said. “Ten years ago, almost to the date, a tragic van crash killed seven young people and severely injured five more – all part of a traveling sales crew. What happened that night in Janesville shed light on an industry that was unregulated, and left unchecked, often abusive to its employees. Today, I will sign Malinda’s Act. Malinda was an 18-year-old young lady starting out in life when she was tragically killed. And it is people like Malinda, Amber, and Monica who we intend to protect by signing this law.”

The Governor was joined at the bill signing by Phil Ellenbecker, the father of Malinda Turvey, Bonnie Lettman, the mother of Amber Lettman, a 16-year-old from Oregon who was also killed in the crash, and Monica Forbes, who was left paralyzed by the Janesville crash.

In 1999, then Attorney General Doyle prosecuted those responsible for the crash including Y.E.S., a subscription sales company based in DeWitte, Iowa. He also advocated for legislation regulating the traveling sales industry in Wisconsin.

The Act sets multiple protections for employees on traveling sales crews. In part, the Act:

· Requires at least semi-monthly payment of all wages earned;

· Requires all vehicles used to transport workers to be certified for all safety codes, including having a seat belt for all passengers;

· Prohibits an employer from abandoning employees because they are sick, injured or have been arrested;

· Prohibits an employer from taking away a worker’s money, ID, phone or any other personal property during the course of employment with the traveling sales crew; and

· Prohibits an employer from restricting communication between the worker and family or friends.

The Act also protects consumers from scams and homeowners from dangerous criminals knocking on their doors. In part, the Act:

· Requires employers who utilize traveling sales crews in Wisconsin or who recruit crewmembers in Wisconsin to obtain a certificate of registration from the Department of Workforce Development (DWD) prior to entering the state. The information collected as part of the registration process will include any prior conviction record of all crewmembers;

· Requires traveling sales crew workers to carry a DWD-issued ID badge and a copy of the certificate of registration with them at all times;

· Requires the employer to request a registration stamp from a local municipality. The stamp must be placed on the certificate of registration prior to selling door-to-door in any community;

· Requires the notification of local law enforcement of planned sale activities; and

· Limits the times of day salespersons on a traveling sale crew can engage in sales activities to between 9:00 a.m. and 9:00 p.m.

This bill does not apply to fundraising sales by a nonprofit organization, such as the Girl Scouts, or schools and does not preempt a county, city, village, or town from enacting a local ordinance regulating the sale of goods or services to consumers from house to house, on any street, or in any other place that is open to the public.

Governor Doyle thanked Senator Jon Erpenbach and Representative Sondy Pope-Roberts for their work on the bill.

MADISON, Wis. (AP) -- Wisconsin lawmakers are moving to approve the nation's toughest regulations on companies that use traveling sales crews. The rules are aimed at those who recruit young adults to rove the country selling magazines, soap and other products. Critics say they too often put workers in unsafe and unfair conditions. The rules would require workers to be employees rather than independent contractors, which would make them subject to labor laws. Companies that employ crews would have to register with the state and tell workers in writing where they will work and what they will be paid. The measure passed the Senate 27-6 and will be debated in the Assembly later Tuesday.

The pitch for traveling sales jobs is appealing--travel the country and make money. But, a Middleton lawmaker says the students are being taken advantage of. "They say the job is not for everyone and I say it's not for anyone," says Kristen Rae Spicer. On Tuesday, Kristen Rae and her father traveled all the way from Atlanta, Georgia to address a Senate committee. "There was nothing written for me (like) this is where you're going to be living, this is what's required of you, this is what you're going to get paid," says Kristen Rae. In the summer of 2005, the then 18-year-old, went door-to-door selling educational books in Pennsylvania. "When she came back after that summer she was a shell of a person," says Guy Spicer, Kristen Rae's father. State Senator Jon Erpenbach of Middleton says that's not uncommon. The Democrat's interest stems from a 1999 crash in Rock County involving a traveling sales crew. Seven young people died and five were injured. It happened when the unlicensed driver switched seats with a licensed driver at 80 miles-per-hour after spotting a police car. "This bill is named after Melinda Turvey, one of the victims of the crash," says Erpenbach. The bill would make it illegal for traveling sales companies to hire minors. It would require an employer disclosure statement. And, it would prohibit the use of independent contractors. "If the independent contractor status was taken away from the students who did this, this would go from running your own business to a sales job," says college recruiter Katie Barmann, a UW graduate. But Erpenbach disagrees. He says the companies go with independent contractors to avoid possible legal problems. "Any company in this state, working in this state, recruiting in this state, would easily be able to abide by this legislation," he says. As for Kristen Rae, she's moving on. But, there's one part of her summer job experience she'll never forget. "On July 25, 2005, I was raped by a coworker of mine," she says. Kristen Rae says a simple background check, which is also included in the bill, may have kept her safe. A spokesperson for the one company at Tuesdays' hearing says her organization is "very up front about everything the job entails." More than 30-people testified. No action was taken.

A civil lawsuit filed against Vincent Pitts, president of the National Field Selling Association and owner of Palmetto Marketing/Sunshine Subscription Agency was settled for $600,000.00 on October 1, 2008.

The lawsuit stems from the violent assault and rape of a 50-year-old Menomonie, Wisconsin woman committed by Brandon Green a traveling door-to-door magazine salesman.

A one-vehicle rollover crash Sunday afternoon along Interstate 10 near Sonora killed one man and injured three others, according to a Texas Department of Public Safety official in the agency's Ozona office. Zach Dobson, 26, an independent contractor from Vernal, Utah, was pronounced dead at the scene, said the DPS official, who did not want to be named. DPS Ozona said the driver of the vehicle, Ian Moore, 18, of Phoenix, was eastbound about 4:10 p.m. Sunday when he was distracted and drove into the median. He overcorrected, and the car rolled five times. Moore and Michael Burke, 18, of Phoenix, were taken to Lillian M. Hudspeth Memorial Hospital in Sonora and were both listed in stable condition, according to DPS Ozona. A fourth passenger, Dwayne Meek, 21, also from Arizona, was in serious condition and taken to Shannon Medical Center in San Angelo, DPS Ozona reported.

Renewed call for Traveling Sales Crew Regulation
While the state budget was crawling forward this fall, a Dunn County court decision made major headway for community victims of traveling sales crews, which was recently upheld by an Appeals Court. The decision held liable the traveling sales crew company for the hiring of an individual they knew was a risk with a criminal history. While working on the traveling sales crew, a member of the crew forced his way into a Hudson woman’s home and raped and beat her. Traveling sales crews can often be safe harbor for criminals moving from state to state. This decision has highlighted a string of crimes committed by traveling sales crews, many of the same companies that have crews in Wisconsin going from door to door. In September of this year, six individuals were arrested in Mequon for violating solicitation laws, they were warned by police but still went back to work in Mequon the following day. The 43 year old crew chief had a felony warrant from Colorado and a record with 15 known alias names. His extensive criminal history includes several drug offenses, assault with a deadly weapon, domestic abuse and battery.

The traveling sales crew bill was first introduced in the 2001-2003 session and has been introduced in subsequent Legislative sessions only to die at the end of session in an Assembly Committee. There is no excuse for the continued opposition to a bill to simply require traveling sales crews to register with the Department of Workforce Development. The Assembly has no reason for delaying basic human protections for employees of traveling sales crews, like the right to be paid for their work.

Every day people with known criminal history go from door to door in this state. Our neighbors, family members, and baby sitters that answer the door are at risk. Some members of the Legislature call themselves tough on crime, yet the simple registry of sales crews cannot move forward in the Assembly. The traveling sales crew bill has languished in the Assembly Small Business Committee chaired by Representative Moulton since April.

We need to know what companies are in our state going door to door and we need to know who they employ. Without this nexus of information we do not have the ability to find and arrest crew members with outstanding warrants or the ability to go after a company that is negligent in its actions by hiring dangerous criminals. It is time for opposing Legislators to step up to the plate on this issue.

The only registered organization in opposition to Senate Bill 80, Malinda’s Law, is the door to door sales company, Southwestern Company. In support on the website are: Wisconsin Council on Children and Families, Wisconsin Independent Business Inc, Wisconsin Merchants Federation, and the Wisconsin State AFLCIO.

On the interstate in Janesville in March of 1999, seven children and young adults died and five more were seriously injured in a van crash. The driver of the vehicle was operating without a license and attempted to switch driving with a passenger when the vehicle passed a police officer on the highway. His action caused the crash and tragic death of members of the traveling sales crew. One of those members was Malinda Turvey, daughter of Phil Ellenbecker from Verona. Since the crash Ellenbecker has worked tirelessly to regulate traveling sales crews and give employees of the crews basic employee rights. Phil and Malinda are the inspiration for this legislation.

It is my hope that Representative Moulton, R – Chippewa Falls and the rest of the Assembly Small Business Committee will stand up for safety in our communities and pass out of committee the simple regulation of traveling sales crews in Wisconsin. All three defendants entered their pleas today in San Diego before the Honorable Barry Ted Moskowitz, United States District Judge.

SAN DIEGO ---- A former Vista resident, his wife and daughter have pleaded guilty to federal criminal tax offenses involving millions of dollars made from selling magazine subscriptions.

Lonnie R. Divine; his wife, Yvonne, 45; and daughter, Deanna McKinnon, 39, entered their pleas Monday in U.S. District Court in San Diego.

Judge Barry Ted Moskowitz set sentencing for March 9. Maximum penalties range from a year in prison and a $100,000 fine to five years in prison and a $250,000 fine for each charge.

Prosecutors said Lonnie Divine admitted he owned and operated a business under many company names between 1993 and 1997, but it primarily involved selling magazine subscriptions door to door for more than $11 million.

Divine evaded taxes by transferring money through several bank accounts, making payments of about $1.8 million to his Nevada casino accounts in Las Vegas and Lake Tahoe, acquiring assets and investing funds, among other ways, according to U.S. Attorney Carol Lam.

Yvonne Divine and Deanna McKinnon pleaded guilty to one count each of failing to file tax returns while earning income from the business.
